Gov. Newsom Signs Law Making California 1st State to Ban Discrimination Against Natural Hair

Gov. Gavin Newsom signed into law Wednesday a bill making California the first state to ban workplace and school discrimination against black people for wearing hairstyles such as braids, twists and locks.

The law by Democratic Sen. Holly Mitchell of Los Angeles, a black woman who wears her hair in locks, makes California the first state to explicitly say that those hairstyles are associated with race and therefore protected against discrimination in the workplace and in schools.

California.s new law, which takes effect Jan. 1, is significant because federal courts have historically held that hair is a characteristic that can be changed, meaning there’s no basis for discrimination complaints based on hairstyle. The U.S. Supreme Court recently declined to hear the case of an Alabama woman who said she didn’t get a job because she refused to change her hair.

Shereen Africa, who was having her hair re-braided by Elicia Drayton, said she used to work at a television station in Mississippi where a black anchor quit after facing resistance to wearing her hair in locks.

THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:

SECTION 1. The Legislature finds and declares all of the following:
(a) The history of our nation is riddled with laws and societal norms that equated .blackness,. and the associated physical traits, for example, dark skin, kinky and curly hair to a badge of inferiority, sometimes subject to separate and unequal treatment.

(b) This idea also permeated societal understanding of professionalism. (d) Workplace dress code and grooming policies that prohibit natural hair, including afros, braids, twists, and locks, have a disparate impact on Black individuals as these policies are more likely to deter Black applicants and burden or punish Black employees than any other group.

(g) Acting in accordance with the constitutional values of fairness, equity, and opportunity for all, the Legislature recognizes that continuing to enforce a Eurocentric image of professionalism through purportedly race-neutral grooming policies that disparately impact Black individuals and exclude them from some workplaces is in direct opposition to equity and opportunity for all.

In the name of fairness and equality, whites are ordered under penalty of hate crime prosecution to accept any hair style worn by blacks, because blacks are tired of white people being seen as the successful, cooperative ethnicity. The next time you get your earthworms done, Mitchell, read a dictionary for the definition of “irony”.

    Also, it seems that negresses in advertisements always have these huge poofy frizzy do’s. What’s up with that. I find it disgusting, but it also makes me wonder how it factors into “their” real agenda.

  2. ‘Dreadlocks’ as they are called today, originated in ancient Greece. You know, Greece, the bridge from the lands of the Caucasoids to Negroids by way of the eastern Med Sea. Even with the appropriation game, the proverbial oppressed fail to know history.

    Hair is used as a form of expression: principally, to identify between male and female members of society (1 Co 11:6). When part of an in-group, hair becomes a part of the uniform. Individual adherence to the code of the tribe allows the tribe to be the expressive entity. Each individual becomes an ambassador of their group, the group being identified by their uniform.

    Lastly, functionality. Grooming is not a nicety, is not an ‘ethnic option’. Nails in competitive sports? Unbound hair in a food line / operating room? Beard stubble when trying to establish an airseal with a gas mask?
    There are unkept white girls’ hair, just as there are black women with very moisturized hair.

    It’s effort. Lack of effort being masked by the lie of expression, most principally: racial expression.

  3. Also, as it pertains *specifically* to women and their hair: so much can be discerned about a woman from only 2 things: her build (somewhat genetic), and especially her hair (entirely controllable).

    As a matter of fact, thinking a bit here, I probably filter all women into MFK categories within 5 seconds of meeting her based on her waist+hips measurements and hair grooming (length, cleanliness, styling).

    One vote for “the waist looks thinner when the hair is fatter”.

    I’ve heard Africans really do tend to have hard-to-manage hair, which is why they tend to shave it off (aka acting white?). It’s not like they need to worry about sunburn. Which in turn is one criminology theory I’ve read, that black behavior is poor partly because they’re severely and chronically deficient in Vitamin D.

    Me, when my barber retired and I couldn’t find a replacement who charged less than $20 for a trim, that’s when I started shaving my head. You can afford many hats at the rate of $20/month. I also get to sleep in an additional 30 seconds on a workday so I’m never going back.
